Abstract/Summary

Examines the unintended consequences of the amendments to the Wills Act 1837 s.9 by the Wills Act 1837 (Electronic Communications) (Amendment) (Coronavirus) Order 2020 on the formalities for making a will. Contends that the pragmatic approach to proving compliance with formalities could be curtailed and this might lead to calls for the introduction of a statutory dispensing power.
