Abstract/Summary

A technical argument that two cases, usually said to show a departure from traditional equitable tracing based on direct substitution of one item of property for another, do not in truth do so: Relfo Ltd v Varsani [2014] EWCA Civ 360, [2015] 1 BCLC 14 and Federal Republic of Brazil v Durant International Corp [2015] UKPC 35, [2016] AC 297.
