Wilde, D. (2022) The constitution of trusts – settlors constituting trusts by “vesting” title without “transferring” title. The Conveyancer and Property Lawyer, 2022 (3). pp. 274-283. ISSN 0010-8200

Abstract/Summary

Argues that – contrary to what the textbooks say – settlors can constitute trusts they have declared by vesting property in trustees without the settlor first owning the trust property and then transferring its title to the trustees: and that the settlor need not have owned the trust property at any stage.
